What is a notarial record of facts (acta de constatación)?

Short answer

It is a document in which the notary records a fact she sees or hears: the condition of a property, the handover of keys, the content of a website or a chat. It serves as evidence backed by public faith (fe pública), for example in court.

What it is used for

  • Recording the condition of a house or an apartment when handing it over or receiving it under a lease.
  • Recording damage caused by construction work next door or by a leak.
  • Recording the content of WhatsApp messages, emails or social media posts before they are deleted.
  • Recording a delivery, a notice or what happened at a general meeting (asamblea).

How it is done

The notary goes to the place, or reviews the device together with you, and describes in the record what she perceives, with the date and time. She can attach photographs or screenshots. She does not give an opinion on who is right: she only records what she saw.

Why it pays to do it in time

A record made at the moment is worth much more than testimony months later. With messages and web pages this is key, because the content can be deleted or edited.
